Terms of Service

The terms on which you use the Beezz app - who runs it, what you get for free, what is paid for and on what terms you can stop.

1. General provisions

These terms set out the rules for using the Beezz mobile app and the beezz.app website. The service is provided by AKN Software Kasper Janowski, ul. Maczka 8, 94-328 Łódź, Poland, tax number (NIP) 7272900394 (the “Provider”).

We make these terms and the Privacy Policy available before your first action in the App: links to both documents stand on the first setup screen, under the “Continue” button, and are in Settings at all times. You accept these terms by continuing from that screen. If you do not agree with what they say, do not use the App - you can delete your Account in Settings or by writing to us.

The rules on the processing of personal data are set out in a separate document - the Privacy Policy.

2. Definitions

  • App - Beezz, a mobile app for iOS and Android together with its server side.
  • User - an adult natural person who has created an Account.
  • Consumer - a User entering into the contract for a purpose not directly connected with their business or professional activity, and also a sole trader who enjoys consumer protection.
  • Account - a User's individual profile, created automatically the first time the App is launched.
  • Household - a shared budget to which a User may invite other people.
  • Free Plan - the free scope of the App's features.
  • Plan BEEZZ - paid access to an extended scope of features. It comes in two forms: an automatically renewing subscription (monthly or yearly), and lifetime access bought in a single payment, which does not renew and does not need to be canceled. The provisions of these terms on renewals, cancellation and the billing period concern the subscription alone.
  • Trial period - a free 14 days at the start of the yearly subscription, after which it turns into a paid one. It is available to new subscribers - the Store decides on eligibility - and it does not cover the monthly subscription or lifetime access. The App shows the length of the trial period and the fee charged after it before the purchase.
  • Store - the App Store run by Apple, or Google Play run by Google. The Store is the seller of Plan BEEZZ: it is the Store that enters into the contract of sale with you, takes the payment and issues the proof of purchase. The Provider is the creator of the App and the supplier of the service itself.

3. Technical requirements

To use the App you need a mobile device running iOS or Android in a version supported by the current release of the App, and access to the internet. An e-mail address is not needed - the Account works without registration.

Data syncs over the internet, so without a connection some of the features are unavailable. We recommend using the current version of the App - older releases may stop working after changes on the server side.

4. The Account and the conclusion of the contract

The contract for the provision of services by electronic means is concluded at the moment when - these terms having been made available to you on the App's first screen - you continue and start setting up your budget. The contract is concluded for an indefinite period, and the Account is free of charge.

  • The Account is created by an adult; one person may have one Account.
  • The Account's technical profile is created automatically and anonymously the first time the App is launched - with no registration, no e-mail address and no password. Until you continue from the first screen, you enter no data into it. To use the Account on another device, link it to a Google or Apple account.
  • You are responsible for securing the Google or Apple account you use to sign in to the App. If you suspect that somebody has gained access to it, secure it with the provider and write to us.

5. Plans, payments and renewals

The Free Plan is free of charge and does not limit the number of entries (apart from the protection against abuse described below the table). Dictating entries, adding them by hand, categories, a limit for the whole month, the monthly balance and the monthly wrapped summary work on it at no extra cost. Plan BEEZZ extends the scope of features. The current scope of each plan and its price are shown in the App before purchase - the list below describes the position as at the date shown at the top of this page.

Numerical limits work forward, not backward: if Plan BEEZZ expires, the recurring entries, category limits, subcategories and savings goals created while it was running keep working - you simply cannot add further ones above the Free Plan's limit. The same goes for entries imported from a bank: they stay in your history.

Protection against abuse. Whatever the plan, one budget accepts up to 2,000 entries and up to 200 dictated sentences in 24 hours, and at most 30 requests a day go from one budget to the AI model - beyond that, the Beezz dictionary suggests the category on its own. That is many times what even a very busy family records; the limits protect the server from automated traffic and do not restrict ordinary use.

The trial period. The yearly subscription starts with a 14-day trial period. During that time you pay nothing, and the App shows on the purchase screen - before you confirm it - how many days the trial lasts and what fee will be charged after it. After 14 days the subscription turns into a paid one and the Store takes the first yearly payment, unless you cancel it at least 24 hours before the end of the trial period. Canceling during the trial involves no charge at all, and access works until the end of it. The day before that moment we remind you of it in the App, and if you have agreed to notifications - by notification as well.

The trial period is available once per account in a given Store and only to new subscribers - the Store decides on eligibility, and the App then shows no free days and states the price straight away. The monthly subscription and lifetime access have no trial period: you pay for them from the first day.

  • Payment for Plan BEEZZ is taken by the Store alone - Apple or Google. The Provider does not take payment directly and has no access to your card details.
  • The subscription renews automatically for a further billing period unless it is canceled at least 24 hours before the end of the current one. Lifetime access does not renew - you pay once and there is nothing to cancel.
  • You cancel the subscription in your account settings in the App Store or Google Play. You can also get there from the App: Settings opens the Store's subscription management panel, but the cancellation itself happens on the Store's side and it is the Store that confirms it.
  • After canceling, you keep access to Plan BEEZZ until the end of the period you have paid for. The rules on refunds are set out in sections 6 (withdrawal), 10 (non-conformity of the service with the contract), 12 (complaints), 13 and 14 (termination by us and a change of these terms) and 16 (a contract entered into by a minor); apart from the cases set out in those sections, the fee for a period already begun is not refundable.
  • The Store converts the fee into the currency of your country and may add the taxes applicable there.
  • We will give notice of a price change at least 30 days before it takes effect; if you do not accept it, you can cancel the subscription before the next renewal. A price change does not concern lifetime access that has already been bought.
Automatic renewal, said plainly. Before you confirm a purchase the App names the plan, its price, how long one billing period lasts and that it renews by itself until you cancel it - and, for the trial period, how many free days there are and what is charged when they end. The Store then asks you to confirm that as a step of its own. You cancel where you bought: the Store's subscription settings, which the App opens for you in one tap from Settings. About a month before a yearly subscription renews we remind whoever is paying for it - in the App, and by notification if they have agreed to those. This is what California's automatic renewal law asks for. We do it for everyone rather than for California.
Deleting the Account does not cancel the subscription. Cancel it in the Store first and only then delete the Account - otherwise the fee will keep being charged. We describe this on the Deleting your account page.

6. Withdrawal from the contract

Who the seller is here. You buy Plan BEEZZ in the App Store or in Google Play, and it is Apple or Google that enters into the contract of sale with you, takes the payment and issues the proof of purchase. You therefore exercise the right of withdrawal from the purchase against the Store, on its terms and through its channel. Below we describe how that works, and what happens to the contract for the provision of the service that you enter into with us.

You can end the contract for a free Account at any time by deleting the Account - it costs nothing and requires no reason to be given.

A refund for Plan BEEZZ. You file the request with the Store where you bought it: in the App Store through reportaproblem.apple.com, in Google Play through the refund form in the store. The Stores consider them under rules of their own and it is they who return the money. If you believe a refund is due to you and the Store has refused, write to kontakt@beezz.app - we will approach the Store on your behalf and, where it is within our power, grant the refund on our side.

Withdrawal from the contract for the provision of the service. A Consumer has the right to withdraw from a distance contract within 14 days without giving a reason. By starting Plan BEEZZ you receive access to the paid features immediately, that is before that period has expired - and it is that which you request when you confirm the purchase. Under Article 38(1)(1) of the Polish Consumer Rights Act of 30 May 2014 (the “Consumer Rights Act”), the right of withdrawal expires only once the service has been fully performed, where you expressly requested that and were informed of its effect.

We say this plainly, because it is sometimes put the other way round: a subscription running over time is not a service that has been “fully performed” for as long as the period you have paid for lasts. Within 14 days of the purchase you may therefore withdraw from the contract as to the part not yet performed. If you have made use of it, you will pay for the time up to the day of withdrawal, in proportion to the price of the period (Article 35 of the Consumer Rights Act) - we refund the rest. It is enough to send the statement of withdrawal by e-mail to the address in section 1; you may use the model form below, but you do not have to.

Date. (*) Delete as appropriate.

For lifetime access you pay once, but the service keeps working for the whole time it lasts - so it is not a performance that is “fully performed” at the moment of purchase, and the exception in Article 38(1)(1) of the Consumer Rights Act does not cover it. You therefore have 14 days to withdraw from that purchase as well: we then account for the value of what was performed up to the day of withdrawal, and refund the rest.

7. Rules of use

By using the App, you undertake not to:

  • attempt to circumvent security measures, to gain access to other people's data or to parts of the system that are not available to you,
  • use the App in a way that disrupts its operation, including by automatically generating traffic or artificially loading the server,
  • decompile the App or create adaptations of it, beyond the scope permitted by law,
  • put unlawful or offensive content into the App, or content that infringes other people's rights,
  • share the Account with third parties or resell access to Plan BEEZZ.

A gross or persistent breach of these rules may result in the Account being blocked or deleted. Before we do that, we will call on you to stop the breach - in the App or by e-mail - stating what exactly constitutes it and allowing at least 7 days for it. We block an Account without notice only where the breach threatens the security of other people's data or the operation of the service; we inform you of it immediately after the fact.

You may appeal against the blocking or deletion of an Account by writing to kontakt@beezz.app - we answer within 14 days. If an Account was blocked without good reason, we restore it, and we extend the unused time of a paid Plan BEEZZ period by the length of the block.

8. Households and invitations

  • A single Household may have at most four people - two on the Free Plan, four where any one of them pays for Plan BEEZZ. An invited person never pays.
  • An invitation works on a single-use code valid for 7 days, which you pass on outside the App. You are responsible for whom you pass it to.
  • A person who joins a Household sees its whole history - including entries from before they joined.
  • By entering other people's names and spending, you take on the responsibility of informing them of it. Details in the Privacy Policy.
  • You leave a Household yourself. The App has no feature today for one person to remove another household member - everybody leaves the shared budget themselves, from their own Settings. After leaving, they lose access to the shared history, and the entries they have made stay in the Household as its financial history, ceasing to be attributed to anybody.
  • A Household that the last person has left is deleted together with everything in it.

9. The nature of the service and liability

Beezz is a tool for recording spending, not financial, investment, tax or accounting advice. The figures in the App are not a basis for filings with any authority.
  • The App does not connect to a bank and does not download the transaction history of your bank account. You add the entries yourself - by hand, by voice, or by approving suggestions recognized from payment notifications - and you are responsible for their accuracy.
  • We make every effort to keep the App running without interruption, but we reserve the right to technical breaks, announced in advance so far as possible.
  • Towards a Consumer we are liable on general principles - for damage caused through our fault, including a loss of data that occurred for reasons on our side. We are not liable for what is beyond our control: for the financial decisions you make yourself, looking at your own figures, or for a loss of data caused by a failure of your device, by the operation of its operating system, or by deleting the App.
  • No provision of these terms excludes or limits a Consumer's rights under mandatory provisions of law - in particular liability for the conformity of a digital service with the contract (section 10) and liability for personal injury.
  • Towards Users who are not Consumers and are not sole traders enjoying consumer protection, our liability is limited to the amount of the fees paid in the last 12 months and does not cover lost profits.

10. Conformity of the digital service with the contract

The App is a digital service within the meaning of Chapter 5b of the Consumer Rights Act, and we are liable to a Consumer for its conformity with the contract. The service conforms to the contract where it matches the description in these terms and the description in the Store, is fit for the purpose that a household budgeting app ordinarily serves, and is supplied in the latest version available at the time the contract is concluded.

Updates. For the duration of the contract we supply the updates necessary to keep the service in conformity with the contract, including security updates, and we inform you of them in the App or through the Store. If you do not install an update within a reasonable time, we are not liable for a lack of conformity resulting solely from its absence - provided that we informed you of the update and of the consequences of not installing it.

Where the service does not conform to the contract, you may demand that it be brought into conformity. We may refuse where that is impossible or would require excessive costs. If we do not bring the service into conformity within a reasonable time of your notification and without significant inconvenience to you, or if the lack of conformity is serious enough to justify it straight away, you may make a statement reducing the price or withdrawing from the contract.

  • A reduction of the price must stand in the same proportion to the price under the contract as the value of the non-conforming service stands to the value of a conforming one.
  • For a service supplied continuously, the reduction of the price concerns the period during which the service did not conform to the contract.
  • The amount due is refunded without delay, and no later than within 14 days of receipt of the statement, by the same means of payment that you used - and therefore, for a purchase in the Store, through the Store, unless you agree to another means that costs you nothing.
  • You may not withdraw from the contract where the lack of conformity of the service with the contract is immaterial; it is presumed to be material.

Changes to the service. We may change the digital service in an immaterial way, and also to the extent necessary to keep it in conformity with the contract. If a change materially and adversely affects your access to the service or your use of it, we will give you advance notice of it on a durable medium, and you will be able to terminate the contract without notice within 30 days of being notified - unless we give you access to the service without the change and at no additional cost.

Liability for the conformity of the service with the contract is separate from refunds considered by the Store. You direct claims on that ground to us - by the route described in section 12 - regardless of the fact that the payment was taken by Apple or Google.

11. Intellectual property

The App, its name, logo, interface and documentation are protected by copyright and belong to the Provider. By creating an Account you receive a non-exclusive, non-transferable license to use the App for your own purposes, for the duration of the contract.

The data you enter - expenses, categories, notes - stays yours. We claim no rights to it and we do not use it for purposes other than providing the service.

12. Complaints

File a complaint by e-mail to kontakt@beezz.app. Describe the problem and give - if you can - the e-mail address of the Google or Apple account connected to the Account, the version of the App and the device model.

We answer within 14 days of receiving the complaint. A failure to answer within that time means that a Consumer's complaint has been upheld.

Complaints concerning the payment itself or a refund of money are considered by the Store where the purchase was made.

13. Termination of the contract

You can terminate the contract at any time and without giving a reason, by deleting the Account in the App. We describe how on the Deleting your account page.

Deleting the Account of your own accord does not entitle you to a refund of the fee for a subscription period already begun - access works until the end of it. The exceptions are set out in sections 6 (withdrawal within 14 days), 10 (non-conformity of the service with the contract), 14 (a change of these terms) and 16 (a contract entered into by a minor), and in the paragraph below.

The Provider may terminate the contract on 30 days' notice, in particular where it ceases to provide the service. In that case we refund the unused part of the Plan BEEZZ fee, in proportion to the remaining period, and for lifetime access - in proportion to the announced period of the service's availability. We make the refund directly or through the Store, depending on which route is possible in the particular case.

14. Changes to these terms

We may change these terms only for important reasons, and an important reason here is one of four: (1) a change in the law, or in its interpretation by a court or authority, that concerns the service; (2) a change in the scope of the service - the addition, change or withdrawal of a feature described in these terms; (3) a necessity arising from App Store or Google Play requirements; (4) security considerations or the prevention of abuse. The change must stand in a direct connection with the reason we invoke - we do not change these terms “while we are at it”.

We will give notice of a change in the App or by e-mail at least 14 days before it takes effect, stating what exactly is changing. If you do not accept the changes, you may terminate the contract before they take effect by deleting the Account - at no cost at all - and we refund the unused part of a paid Plan BEEZZ period proportionally. A failure to object by the day the changes take effect means that they are accepted; a failure to react does not, however, mean agreement to a change of which you were not notified.

To a contract for lifetime access already concluded and paid for, we apply these terms in the wording in force on the day of purchase, as regards what you bought - a change of these terms cannot take away a feature you paid for in a single payment.

We also tell the App Store and Google Play about a material change to these terms, to the Privacy Policy or to the way the App charges for anything. In some places - Texas among them - that notice is what lets a Store ask a parent to consent again on behalf of a minor. Section 16 describes the rest of it.

15. The App Store and Google Play

You install Beezz from Apple's App Store or from Google Play, and you buy Plan BEEZZ there too. A second set of rules therefore sits over this one - the Store's - and Apple requires every app that writes its own terms to state the following plainly. We state it in our own words.

  • This agreement is between you and us. It is not an agreement with Apple. Apple is not a party to it, and we alone - not Apple - are responsible for the App, for what is in it and for anything it does.
  • What the license covers. You receive a non-transferable license to use the App on Apple-branded devices that you own or control, on the terms of the Apple Media Services Terms and Conditions. If you share the App through Family Sharing or buy it in volume, the people you share it with use it on those same terms.
  • Support is ours. Apple has no obligation whatsoever to maintain the App or to support it. Ours is described in section 12 and runs through kontakt@beezz.app.
  • Warranty. The warranty for the App is ours. If the App turns out not to conform to a warranty that applies to it, you may notify Apple, and Apple will refund the purchase price to you; beyond that refund Apple has no warranty obligation of any kind. Everything the warranty does not cover is ours to answer for, in the limits within which the law lets us limit that.
  • Claims. We, not Apple, answer any claim made by you or by anyone else about the App - including a claim that it caused harm, that it fails to meet a legal or regulatory requirement, or that it breaks consumer-protection or data-protection law.
  • Intellectual property. If anyone claims that the App infringes their intellectual property, we - not Apple - investigate, defend, settle and discharge that claim.
  • Where you are. By using the App you confirm that you are not located in a country subject to a United States Government embargo, or designated by that government as a country supporting terrorism, and that you are not listed on any United States Government list of prohibited or restricted parties.

  • Other people's terms. While using the App you must also keep to the terms of whatever else you are using through it - your mobile data plan, for instance.
  • Apple may enforce this. Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance of them Apple has the right - as a third-party beneficiary - to enforce them against you.
Google Play. On Android the seller is Google, and the purchase is covered by Google Play's own terms alongside these. What is written above about Apple - that the agreement is with us and not with the Store, and that support and claims sit on our side - is equally true of Google.

16. Age, minors and a parent's consent

An Account is created by an adult. That is in section 4 and it has not changed: Beezz is a household budget, not an app for children, and we do not knowingly enter into a contract with anyone under 18.

Several places have since turned that house rule into somebody's legal duty. Texas, Utah and Louisiana require the app stores to establish which age category a person falls into - under 13, 13 to 15, 16 to 17, or adult - and to obtain a parent's consent before a minor downloads an app or pays for anything inside it. The duty reaches the developer as well, and this section says what we do with it.

  • We give the Stores an age rating for the App and for every purchase that can be made inside it, and we keep it accurate.
  • We ask about age at purchase in the US App Store. On an Apple device running version 26.2 or later, when the buyer's App Store account is a US one, the App first asks Apple, just before payment, whether an age-verification law applies to that account. If not, the purchase goes ahead with no question. If so, the App asks Apple for the age range declared on the Apple Account. When the App cannot read the App Store account's country, the region set on the phone decides. An adult buys. A person under 18 cannot buy Plan BEEZZ, and the App offers no parental-consent path - under section 4, an Account is created by an adult. Declining to share an age, or an answer that cannot be read, stops the purchase; it can be tried again.
  • The answer serves that one purchase only. We do not store it, we do not log it and we do not join it to anything else we hold about you - which is why it is not in the table in section 4 of the Privacy Policy. The App never receives information from a Store about a parent's consent. Outside the US App Store, on Apple systems older than 26.2 (where Apple offers no way to check whether such a law applies) and on Google Play, nobody is asked about age.
  • When we materially change these terms, the Privacy Policy or the way the App charges for anything, we tell the Stores, so that a parent can be asked again where the law requires it.
  • An agreement a minor entered into without a parent's verified consent does not bind that minor. If we learn of one, we close the Account and refund the whole fee for the current period - not just the part in proportion to what is left of it.
What this does not do. It does not make Beezz an app for children. A household member on the list is still a name typed in by an adult, with no sign-in of their own and no access to the App - section 15 of the Privacy Policy says what that means when the name is a child's.

17. Final provisions

Matters not governed by these terms are subject to Polish law. The choice of Polish law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.

If you are in the United States. Choosing Polish law takes away no right that the law of your state gives you and does not let us bargain away. We have deliberately put no arbitration clause and no class action waiver into these terms: if something goes wrong between us that e-mail cannot settle, you keep whatever court your own law gives you, and nothing here shortens the time your law allows you to bring a claim.

A Consumer may make use of out-of-court means of dealing with complaints and pursuing claims - in Poland, in particular by turning to a district or municipal consumer ombudsman, or to a provincial inspector of the Trade Inspection. Information about these procedures is made available by the Polish Office of Competition and Consumer Protection at uokik.gov.pl. A Consumer living in another EU country may also turn to the consumer bodies of that country.
